NSW Order 43 Coal Mine Workers Medical

Coal Services Health Monitoring Requirements for Coal Mine Workers Order No. 43 (Order 43) builds on the processes and systems that were established under Order 41 to protect the health and safety of workers in the New South Wales coal industry.

Order 43 officially replaced Order 41, and any associated schedules, on the 1st of July 2018.

For the purposes of NSW Order 43 Coal Mine Workers Medical the following definitions are applicable:

A coal mine worker means a person who carries out work at a coal mine for a person conducting a business or undertaking. It does not include a person who works in an environment in which they are not exposed to coal dust, unless the person has previously worked in an area of a coal mine in which they were exposed to coal dust.
A worker means a person who is about to commence work at a coal mine for a person conducting a business or undertaking, including a person who has previously worked at a coal mine and is about to commence work at a different coal mine.

MEDICAL ASSESSMENT

Jobfit has approved and appropriately qualified medical practitioners and registered nurses to perform NSW Order 43 Coal Mine Workers medical assessments. Once approved, the Order 43 medical can be released to the requestor.

Order 43 medical examinations are conducted at the following Jobfit locations:

Most important, the employer requesting an Order 43 medical must download and complete the Coal Services Role Requirements form. Furthermore, the completed form must be uploaded at the time of submitting the booking request.

PRE-PLACEMENT ORDER 43 MEDICAL

A Pre-Placement Order 43 Medical Assessment should be completed where the worker/candidate has moved to a new company within the NSW Coal Industry. This can be treated like a pre-employment medical for the NSW coal mine site.

A pre-placement Order 43 medical includes:

Chest X-Rays

Jobfit provides chest x-ray services to International Labour Organisation (ILO) Standards in synergy with accredited imaging providers. This highly complex and validated approach to radiology reporting records disease progression with the utmost accuracy.

Pre-employment chest x-rays

A pre-employment chest x-ray is required for all workers on entry to the NSW mining industry. Existing workers who are changing roles are not required to undergo a chest x-ray, if they can provide an ILO chest x-ray less than three years old.
Respirator Fit Testing

Also known as a Fit Test, Face Fit Test or Dust Mask Fit Test, a Respirator Fit Test measures the effectiveness of the seal between a respirator and its wearer’s face. Every face is different, so there’s no one-size-fits-all solution to dust masks. Thankfully, a Respirator Fit Test ensures an airtight seal that protects employees against hazardous substances in the workplace.

Our highly trained team performs Quantitative Fit Testing at our Jobfit centres located in Newcastle and Parramatta. Please note, if your Order 43 medical examination is conducted at our Liverpool, Mascot, Blacktown, or Brisbane Airport centres, the required Respirator Fit Test will be conducted at our nearest associate provider.

Our Respirator Fit Testing can be used for any type of tight-fitting respirator. This is important, as workers must be fit tested with the specific make, model, style, and size of the respirator that they will be using.

This respirator will have a probe attached to its facepiece, which will be connected to a machine by a hose. The machine, known as a portacount, then measures the amount of leakage into the facepiece.

If workers wear additional PPE or prescription eyewear on the job, it should be worn during this Fit Test. That’s because earmuffs, hardhats, visors, or even heavy clothing can interfere with the way a respirator fits. Likewise, workers are also required to be clean shaven during your fit test and any respirator use.

Jobfit performs all drug and alcohol testing according to the relevant Australian & New Zealand Standard (urinary drug testing to Australian Standard AS/NZS 4308:2008 and oral fluid drug testing to Australian Standard AS/NZS 4760:2019). In the event that an instant drug test or laboratory drug test is non-negative, it is mandatory under the Australian Standards for the sample to undergo further confirmation testing within a NATA accredited laboratory before a final result is issued. This further confirmation testing will incur an additional cost, and is not included in the cost of the medical. Payment of the additional fee will be required before the medical results can be released.

I acknowledge that in the event of a non-negative drug test result, I will be required to pay an additional fee of $174.90 (incl GST) for mandatory GCMS confirmation testing before the medical result is released.

PERIODIC ORDER 43 MEDICAL

If the worker has previously completed an Order 41 or Order 43 previously, for the same company in the same term of employment, they should complete a Periodic Order 43 Medical Assessment.

Every coal worker must undertake a Periodic Order 43 Medical Assessment:

Every 3 years from the workers Pre-Placement Medical Assessment, or not more than 3 years from when they commenced work (whichever is earlier); and
Not more than every 3 years after that.

A periodic Order 43 medical includes:

Periodic chest x-rays
- Underground coal workers must undergo a chest x-ray every three years or at a shorter interval if indicated in their last medical.
- Open cut worker involved in the production, processing or maintenance of coal must undergo a chest x-ray every three years or at the interval recommended in their last medical.
- Workers with a history of hazardous dust exposure must undergo a chest x-ray every three years.
- Other workers must undergo a chest x-ray every six years.

Order 43 Exit Medical

Employers must ensure that an exit medical assessment is offered to each worker who is retiring or otherwise ceasing work. This is to ensure that any conditions that may impact on the worker’s health in retirement are identified, and an appropriate course of action is implemented.

The exit medical assessment is comprised of the components for a periodic medical assessment, except for respiratory fit testing as follows:
